Eleven states require the consent of every party to a phone call or conversation in order to make the recording lawful. "Two-party consent" laws exist in California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington.

See Cal. Penal Code § 632

(a) Every person who, intentionally and without the consent of all parties to a confidential communication, by means of any electronic amplifying or recording device, eavesdrops upon or records the confidential communication, whether the communication is carried on among the parties in the presence of one another or by means of a telegraph, telephone, or other device, except a radio, shall be punished by a fine not exceeding two thousand five hundred dollars ($2,500), or imprisonment in the county jail not exceeding one year, or in the state prison, or by both that fine and imprisonment.

Federally it is not illegal to do one-party consent, and since these videos have not been filmed in "one-party consent" states and DC they are fine. Unless of course they accidentally went into Maryland when they thought they were in DC (it's possible). I'm sure they consulted with a lawyer regarding wire-tapping/secret recording because that is what they do.

Also, they would establish it is untrue during the lawsuit. They only need to claim it is untrue to bring the suit.
