according yo law, if a show wasn't aired on german TV yet, it's not allowed for Netflix to let people stream it.

Content owners simply like to sell their content on a per-country basis because it makes them more money.
If a something isn't on Netflix Germany it usually means that...
Someone else paid the content owner for exclusive rights to publish said content (or at least they're hoping someone will/still negotiating)
Dubbing etc isn't finished yet
Their market research says there are not enaugh potential viewers to justify the investment - at least right now
Netflix is actively banning VPNs
They're actively trying to ban VPNs because the content owners demand them to - Netflix has no reason to care as long as you pay them.
