How can you be capable of locating on-point precedents but be blithely unaware of the details of this case?
Epic absolutely could have said "We're withdrawing our direct payment option while the courts decide if Apple can legally remove our app because of said payment option." If the court rules in their favor, direct payment goes back in without issue. If they lose, at least their developer account hasn't been pulled and customers can continue using the app and making purchases in it.
