What is the problem with a testing facility being a non-profit? The pursuit of profit has corrupted a number of institutions. The implication in the article is that the pursuit of profit may be corrupting the efforts of some law schools; maybe they have one more motive for their existence than they need in order to function properly.

A manager or administrator does not need to be a subject matter expert. I manage IT guys. I don't need to be able to troubleshoot a server in order to manage a schedule. That she attended law school is only ancillary to her job in administering this program and attention paid to whether or not she passed the bar is a distraction. It says nothing about her ability in running this organization. It only speaks to her eligibility to legally practice law, which is not the subject of this article.

She said absolutely nothing about what attorneys should or should not be tested on. The only thing she spoke about was current and past performance on the test that her facility administers, a test that she did not create. If you have a problem with what is on the test then perhaps you should bring that up with the judges and whatnot that actually did write the test and not lay it all at the feet of the woman who just grades it.

Again, while she did not say what she personally thought of the test, the fact that this is the only test between practicing and not is the state of things today. If that is how we decide who is or isn't a lawyer then of course we do not want people who can't pass the test to be entitled to call themselves lawyers anyways. The analogy to doctors was perfectly relevant. Working with a bad lawyer can be catastrophic.

For your final point, I have no specific opinion on the price of law school. Does it cost us some lawyers? Probably not too many with scholarships and multiple routes to post graduate work. Does it affect rates? Perhaps. Though as the article specifically mentions that the income of solo lawyers has plummeted I can't imagine that they are charging too much. Too, we have pro bono programs and other assistance programs for the poor. But if you don't think those are enough then feel free to go Street Lawyer any time you like.
