Assistant DA who prosecutes DWI cases arrested on DWI charge

I don't know how you graduated high school if you think that someone could just refuse alcohol screenings on calibrated machines forever and never get a DUI/DWI conviction.

Not once did I state someone could continually refuse Breathalyzers and never get a DUI. Although, with a good attorney, that could be true in my state, Ohio. WHY? Because the issuance of a driver's license is a privilege, and not a right. It is what the BMV is for. Just like how a minor drug offense in some states--without a vehicle involved--can lead to license revocation.

So let's say they refuse it, and their license is suspended for a year. BUT THE ARE NOT CONVICTED OF DUI. (OVI, in Ohio, if you are looking for some internet-troll level of pointing out a fault). Well (again, I don't care to research my state's law) but, after so many refusals, you can no longer get a license. Period.

So, in theory, you could "refuse breathalyzer" but after a point you won't ever get a license. Also, even if you don't blow, you can still be convicted by a jury.
