It wasn't fully established that a person couldn't be arrested for recording or so the story goes. In my opinion it was but my point is that today in 2019 no reasonable officer has a belief that you are breaking the law in the scenario shown in this video. I don't pretend to know the law in Texas but I think the photography issue is settled probably by Turner. Anyway, I settled out of court for $75,000.00 on that case. Saulmon vs Hawthorne (2 of 3) Similar circumstances and word for word comments by my cop and your cop. He asked for ID and I told him I had it but would rather not talk to him. He asked me about my ID again and I asked him to take his flashlight out of my eyes. He cuffed me and told me I was under arrest. I told him my ID was in my back right pocket. He said oh it's too late for that now and much like what just happened to you Patrick it absolutely was not too late to release a lawful citizen instead of making an unlawful arrest. There were other factors in my case such as they were lawfully required to cite me out but instead held me for 4 days without ever telling me what I was being charged with. I eventually posted bail because it didn't appear they were going to release me. They then refused to release my camera and transportation claiming they were evidence of my imaginary crime. One last thing that may be the most important is what I had to go through before the lawsuit eventually settled. The city knew it would be difficult to prosecute me because I had a good attorney and hadn't broken the law. So they declined to file charges, but then filed without notifying me causing me to get a warrant for my arrest. They did this over and over again until my attorney had enough. Mr Cook began calling the chief of police and city attorney daily asking them if they would be filing charges on me that day. By getting verbal verification there would or wouldn't be any charges filed he put an end to the nonsense in that case. And on the 365th day or last day to file they filed again and notified my attorney. This is just a brief summary of what went on for more than a decade with various civil and criminal cases...and only a few details from one of the malicious prosecutions. The reason I share this is because many of you are ignorant of what 75K represents to a person that has been unlawfully thrown in jail dozens of times. It isn't profitable. It is the most expensive and time consuming thing I have ever done. It has literally consumed my entire life though I do enjoy it. I know these words are falling on deaf ears if anybody reads this far because they still picture a brief case with 75K and do not comprehend that isn't a reality. To put it in a way hopefully you might understand no city gives away free money besides to themselves and their employees and friends and family. Winning a lawsuit is not winning in any of my cases. At the time when each settled I thought I did win because I thought the city and police now had to recognize I was right and they were wrong. I thought that meant they couldn't bother me with unlawful arrests and false citations again. I stand corrected. They knew what they were doing and chose to keep me in jail knowing the tax payers would likely have to pay because of it. To them that was winning and worth the expense because the same people did it to me over a dozen times. Maybe I will have to get Patrick to share his opinion on the topic but there is no winning when dealing with unlawful police behavior. Well, at the very least it isn't winning a big bag of loot like so many people suggest. Rather, it is more like winning a big bag of expenses and responsibilities that will occupy your time forever or until the day you no longer want to be involved in the movement.
