IAAL. I wonder if the contract asked if she has a medical condition that could impact her performance or whether she had a condition she believes could impact her performance, because those are two very different questions.

The search and seizure question also intrigues me because I'm thinking about it as it's applied in the US under the fourth amendment (4A). So under 4A (in the simplest circumstance), if a law enforcement officer performs a search and seizure in the absence of a warrant, the obtained evidence would be inadmissible in court (but would be admissible to obtain an indictment through a grand jury because you can essentially indict anyone for anything). Simple example would be a police office walks into your house without a warrant, rummages through your closet and finds drugs. Now the drugs are illegally obtained evidence. This is frequently called "fruit from the poisonous tree" because the only thing is can do is screw the officer if they use it. The officer would need a warrant and to obtain the warrant, the officer would need probable cause to justify said warrant. Now if a family member found the drugs and gave it to the police, the evidence would be legal because they're not law enforcement and thus you don't receive protection from them because they're not the government. However, if a law enforcement officer requested the family member do it, that changes the calculus because then it could be considered an action by the government and then 4A applies. Under maritime law, I'm assuming because everyone on the boat is an officer of the boat and thus is analogous to a law enforcement officer, so that's why it would be an illegal search and seizure. So that's kind of an interesting if that's the reason why.

Heavy caveat, I don't practice this type of law, so I'm (pardon the pun) in unfamiliar waters. Also, this isn't legal advice, just me thinking about interesting legal questions. Any legal advice should be obtained by a maritime attorney licensed in the proper jurisdiction.
