Yes, that's what he wants to do. Harry Reid blew up the filibuster for judicial nominations and Biden can do the same thing for civil rights - the only question is how does he get Republicans to not go full scorched earth on him if he does propose a carve-out?
Why are people still asking this? Republicans aren't going to use Democratic restraint to guide their tactics. If Harry Reid didn't nuke the filibuster for judicial nominations, McConnell would have a couple hundred more judicial vacancies to fill. The notion that he would have let Democrats block Trump filling those vacancies is a bit goofy.
Republicans are going to do bad shit no matter how much Democrats do process performance and no amount of Democratic restraint will stop them.
