The bar should not be 'knew it would cause a crash' the bar should be 'knew it statistically significantly increased the odds of a crash'.

Furthermore - even if nobody knew the designers of that plane should be seriously at risk for jail as well. I don't care how pressured they felt to cut corners and save costs. Some things are unacceptable.

what if it wasn't because they were cutting corners but because of a circumstance they didn't foresee happening? it's impossible to account for every possible circumstance. could have been something is simple as a stack overflow error and one test case that nobody thought about
