Nevertheless, companies are made up of individuals. Individuals make decisions, not companies. There aren't automated decisions made by a sentient LLC or Inc. Contracts are drafted by individuals and signed by individuals acting as agents of their organization.

Yes, individuals within a company can decide what to tell their community. And when the CEO of Bungie signs a contract that the legal team of Activision drafted up for Bungie LLC, he is personally liable for the contents of that contract, even if Bungie LLC is the party. So if something is told to the community that shouldn't be, despite what the employees of his company may feel, he can be held responsible. That may include termination, fines, asset seizures, and so on.

For example, "Activision and the Affiliate agree to be jointly and severally liable for all obligations related to the Affiliate's compliance with the terms of this Agreement" (paragraph 5.3 from the Grant Of Rights in the Destiny contract). As in, if someone fucks something up at either company, the contract can be severed by either party.

Or, more relevant to Deej and my point about the BWU, "Activision and Licensor shall have the mutual right to approve key marketing and public relations plans and briefs" (paragraph 13.2 under Marketing And Distribution).

As for the NDA, you can read all of paragraph 16.1 if you'd like, but the key part is the beginning, where they essentially say that anything not known to the public is to be kept in confidence. NDA enforcement is no joke; just ask Sears, who lost $25MM due to an NDA breach.

Considering that ATVI is outperforming the stock market (in general) and the major indices, I'm pretty sure that the folks at Activision could give 500 less shits about what some whiners on Reddit are saying, so long as the game is making them money. By responding to the community's complaints, they only draw more attention and lend more credence to those doing the complaining, for no material benefit to either company. What, you think if Deej posts some "tell the community everything they want to hear" blog post that it's going to change anything?
