Canada Post ordered to stop delivering controversial Your Ward News

To invert your situation, what about Canada Post's freedom, as a business entity, to enter only into business arrangement that enuresis to their benefit?

Every other business in Canada has the right to refuse to do business with anyone, as long as the refusal isn't based on a discrimination within one of the protected areas in law. (i.e. you can't come in my bar because you're black = illegal, you can't come in my bar because you're ugly = no problem.)

Now I know a distinction has to be made for CP because it's a public service and we should say that public services should be made available to all, regardless. BUT CP is also an "arm's length crown corporation", operating the core public service (delivering 1st class letter mail), but also undertaking commercial activity (delivering parcels and commercial mailings in bulk).

So while they should not (and are not) refusing to deliver addressed mail, it may be acceptable for them to refuse access to their "value-add" commercial enterprise on the grounds that certain business associations may hurt their brand and damage their business.

Further, there are plenty of other companies that provide bulk delivery service. The only area where CP can be argued to have a monopoly (and Sears does argue this) is in delivering to condo buildings. BUT there's nothing preventing any other commercial delivery service from negotiating access to condo mail rooms with the individual condo corporations, or making agreements with developers to secure that access. So even that is only a de facto monopoly and there are plenty of those around.

tl;dr: Canada Post should be able to refuse service outside of the core public service on business grounds.

P.S. I realize it isn't Canada Post making this call, but the Minister. I just wanted tho share that though, and it is apropos to your comment.
