Colorado appeals court rules scent of marijuana not enough to search vehicle

Despite all the horror stories you hear by and large most judges have a bullshit sensor a mile wide, they've seen it all and heard it all. They know when someone is lying, cops included. If you stick to your guns and it actually goes all the way to a trial the judge will smell bullshit, pardon the pun, the judge will say somethin galong the lines of "they are concerned by the actions of the police in this case" and toss it. Nothing will happen to the cop of course but it's a flag to the prosecutor and the cop that you don't want to keep trying that kind of shit.

A friend of a friend that did low level criminal law for a while said it happened fairly often and it always made his day when saw it in court or the odd time he pulled it off for one of his own clients.

The scary thing was when you did draw that judge that would believe anything the judge said. The sad thing was that if you couldn't present yourself well in court or had obvious addiction issues or what not it could really undermine your credibility even if your were telling the truth.
