Well, hey. Be fair. After the 2000 election and Bush v Gore, there was a general consensus that no judge would retire until at least 2005. Since the 2000 election was contested and it went to the Supreme Court, it seemed anti-democratic for Bush to appoint any new justices. Like, an unelected panel of justices appoints the president, then the president gets to control the membership for that panel of justices? That's not democracy.

Anyway, that's why Alito and Roberts were appointed in like the same month in 2005. They wanted to wait until there was a noncontested election, and 2004 was a victory for Bush with the popular vote and the electoral vote. If Bush v Gore had gone the other way, there still wouldn't have been any new judges appointed until 2005. And then we'd see if the re-elected President Gore or the newly elected President McCain had handled things. And if 2004 had gone to Kerry, then he likely would have appointed some new judges (and then most likely, President McCain would have been elected in 2008 as part of a red wave after Kerry got blamed for the Financial crisis)

My point is, don't blame just Nader. These justices are also here because Kerry's campaign went down in flames.
