Contracting office allowing mods after due date? Protest filed.

So, here's the basics of it... Solicitation was written kind of oddly. One section states to return which forms, completed as such... but in another area is states that the bids will be evaluated on price and experience with experience being nearly equal in price.

So, I have done enough of these and have a somewhat boilerplate bid package with cover sheet, synopsis, resume, experience, etc, that I can modify per bid needs. I submit the required forms AND a summary of experience.

I suspect most bidders overlooked the need to submit experience since it wasn't super clear.

The bid was due on April 22, then on April 30 or so, an email goes out to all bidders that says something like "in my haste to get the solicitation out, I forgot to include an experience form. Please fill out attached form and return by May 3".

I email the CO and advise I am out of town and ask if my submitted profile is sufficient. He responds that I am good and don't need to complete the form.

I assume they got a bunch of bids without experience profiles included... and the CO is now trying to give bidders a second chance to submit the experience profile info. To me, that seems improper. I have lost out on bids for forgetting such things when i first began.

At any rate, I protested that any incomplete bids at the time of the original due date should be rejected as nonresponsive.

They do also specifically cite FAR 52.212-1, in the solicitation, which states in (f) that any late offer shall be rejected.

I know I won't be the low bidder. I never am. But I might very well be the lowest acceptable bidder if I can keep them from bending the rules to accommodate nonresponsive bidders. I know that's a bit of a dick move but the rules are the rules.
