Judge to remember witnessing a sexual assault.

Maybe, but only if he registered it emotionally as having witnessed sexual assault. Based on the description of the events, I think it's highly plausible that a witness wouldn't actually even consider it "sexual assault" and might just be "drunken playing around." Surveys of people convicted of sexual assault suggest that they often really didn't believe they were doing anything wrong, and bystanders that didn't intervene might have the same belief. In this case, it wouldn't carry any emotional impact.

I'm 33 and I can't even remember all the people I've slept with, never mind other people's sexual foibles in parties. Putting myself in Judge's shoes, with an extra 20 years of forgetting, I think I'd be unlikely to remember it all.
