CVC 22348(b) VC, Indio, Asking for Reduction

The court can lower fine amounts but is not allowed to modify point counts based on their discretion. The DMV point counts are static and statutory. (CVC 12810) If a defendant is found guilty of 22348 (b) the point count is 2 (per subdivision (d) of the cited section). If a defendant is found guilty of any other speeding violation the point count is 1 (per subdivision (f) of the same section).

I read the other cases and what I believe happened was that the fine was reduced to the same fine as one of the less serious speed violations but the defendant was found guilty of 22348(b) and assessed 2 DMV points. This is consistent with the defendant who said they plead no contest to the allegation. Many mistakes would have been made by the court if they found the defendant guilty of exceeding the 70mph speed limit and also assessed 2 DMV points.
