I wouldn't speak for all of Europe, since we have many different laws here as well. Neither legal system is perfect.

In Europe we might look closer or from other perspectives at each separate case. Since in some countries age is not a factor as predominant as in the US, you might have to look more into specifics like the relationship, surroundings, etc.

HOWEVER

The "european" system which might allow for more nuanced outcomes brings with it huge problems in evidence and trials. You have to check stuff on personal and psychiatric levels that might lead to not getting a conclusive outcome at all. There is more variables.

Fixed age boundaries like in the US (as far as I understand the US legal system) get rid of said problem mostly. You need to prove ages. The motivation behind it don't matter anymore. This brings a whole lot of certainty and safety for victims, as well.
