On Monday SCOTUS will hear a case from agribusinesses arguing against a California law requiring union organizers be allowed access to the businesses on the grounds this requirement constitutes a “taking” and would have to be compensated. The argument flies in the face of precedent, including a pretty direct parallel to a 1960s case where a motel owner sued for compensation for being forced to serve black customers, and could be extended to abolish a staggering amount of routine business regulations.

I guess we hope the new conservative court does not wish to revive too much of the 1930s “four horsemen” tradition of holding exploitative business sacrosanct
