DMCA mass takedown request - the state of play on /r/videos

I seriously doubt this is legitimate. Anything involving the legality of a particular thing would be sent to the administrators of Reddit, and whatever department they have set up for legal, or Condé Nast as Reddit is a subsidiary of Condé Nast- as to which this would be then dealt with by whatever legal team / professionals / lawyers they have hired in that specific department.

I'm going to put it out right here that it's most likely that you're either being trolled due to you and the rest of the mod team being uneducated about law, and they are exploiting this ignorance- or the company sending the DMCA has no clue as to what they're doing, as the claims are bogus. A third option is that an independent user is sending bogus threats of DMCA due to a video putting him or her in a bad light- and she or he wishes to censor the video from appearing on Reddit under false threat to the moderators.

Censoring videos from appearing on Reddit [through DMCA] would be contrary to what a business would want to do- primarily due to the pushing power of Reddit and the frequency of Reddit getting videos, or other tidbits of content 'viral' or popular via the front page of either Reddit, or the front page of the 'hot' queue on subreddits.

All DMCA claims should be sent to the following as per useragreement policy on Reddit;

Anything else sent to not that address is to not be taken seriously, and ignored. A lot of this can be broken down in the email;

You are not an owner of a server, or a webmaster of a server, and thus have no obligation to remove content, unless that is, it breaks US law- however, to remove legal responsibility from users of the site, all content hosted is the responsibility of Reddit.

I request that you immediately notify the infringer of this notice and inform them of their duty to remove the infringing material immediately, and notify them to cease any further posting of infringing material to your server in the future.

Do not say a single thing to them that might implicit you in some other, irrelevant way. It's the same as talking to the police. Just don't.

Please also be advised that law requires you, as a service provider, to remove or disable access to the infringing materials upon receiving this notice. Under US law a service provider, such as yourself, enjoys immunity from a copyright lawsuit provided that you act with deliberate speed to investigate and rectify ongoing copyright infringement.

Same as the first quote- you and the rest of the moderators of /r/videos are not service providers and thus have no obligation to do anything related to legal. This is all the responsibility of Reddit and the administrators / department that deals with legal.

I come with this information out of my own understanding of law and DMCA in particular- as I own a large board on 8chan and all things legal, particularly DMCA, are not the responsibility of the other board owners and I [and our volunteers], but the global volunteers and Hotwheels himself [/u/infinitechan]

We have famously denied DMCAs from people such as Ben Garrison, Peter Coffin, Zoey Quinn, and Julien Blanc.

Know your rights and read up on DMCA- even IF the claim is made by a legitimate person, what they are saying is bogus and incorrect.
