Father and son arrested, charged with murder in shooting death of Ahmaud Arbery

Not a lawyer nor a gun owner, but the fact they saw someone jogging, assumed they were a burglar, then loaded up their guns and blocked this guy's path makes me inclined to call that premeditated/first degree murder.

Isn't there a gun safety saying - 'you don't point a gun (loaded or not) at something you don't intend to kill'?

From the perspective of the runner and what it says in the article

"One of the white men is inside the pickup’s bed. The other is standing beside the open driver’s side door.

The runner crosses the road to pass the pickup on the passenger side, then crosses back in front of the truck. A gunshot sounds, and the video shows the runner grappling with a man in the street over what appears to be a shotgun or rifle. A second shot can be heard, and the runner can be seen punching the man. A third shot is fired at point-blank range. The runner staggers a few feet and falls face down.

(Speculation) From this it sounds as though the victim saw one of the offenders in the back of the truck with a gun so changed his course, once he passed in front of the truck the other offender shot at him and either just wounded or missed him.

At this point imagine you're the runner, what do you (not superhuman you that everyone imagines in their head, normal you) do?

If you run away the person that just shot at you for no apparent reason is probably going to shoot at you again.

If you go the pacifist route and freeze and lie down - again the person just tried to kill you for no apparent reason and you then have no defences or awareness of your attackers.

So, your options are basically death, death, or attempt to take the weapon from the person that attacked you (most likely ending in your death).

Now make that decision in 1/2 a second.

I would argue that this definitely constitutes first degree murder.

"first-degree murder is defined as an unlawful killing that is both willful and premeditated, meaning that it was committed after planning or "lying in wait" for the victim."
