FBI seize Hillary’s emails after finding she had two messages classified as ‘above top secret’ on private server

Who has been indicted for improperly labeled (or not labeled) information? Examples?

One of the indictments against Thomas Drake was for a document marked unclassified. Drake filed a motion to dismiss that specific count of the indictment on the grounds the document was marked as unclassified, but that linked pdf is the denial of that motion.

Several counts of Samuel Morison's conviction (wiki were for photos that he had removed classification markings from (and if you only had copies of his correspondence, all you would see were unmarked photos). NOTE: I am not suggesting Clinton or anybody else involved removed any classification markings themselves as this would be clearly illegal, and as I said earlier the FBI investigation would have been criminal if there was any clear evidence like this.

I am merely refuting the point that "if they were not labeled classified, then there is no case against Clinton" by showing examples that no, lack of classification markings is not by itself enough to absolve one of wrongdoing.

You didn't address anything I said in this next paragraph so I'm just going to repeat it verbatim:

Rice did not use any personal email while she was secretary of state. There are no claims that Powell had any classified information and is not currently running for President.

In fact your source actually supports what I said:

They were all unclassified and mostly of a housekeeping nature.

.

Why would [not seeking public office or holding any government position] matter?

So you're arguing that all these news articles about Clinton's email are not because she's running for president?

Powell didn't break any law or regulations

Correct. He, unlike Clinton, did not have classified information in his email.

TIL, Andrew Napolitano is a Clinton supporter.

Congratulations, you found the one wingnut/strawman who brought up Benghazi over a week ago (not today as you asserted) on Hannity's god-awful show (seriously, how is this guy still on the air?). Ironically, Politifact doesn't even rate his allegation you linked to as false.
