A fetus is not a person until it has a brain capable of consciousness

In the US, the legal debate (see ROE v. Wade) is not over when does a fetus become a person. That’s not even debatable. From the moment of conception it is its own brand new human. No question about it. That’s just a fact. The debate is over whether a women’s interest in her own bodily processes can ever supersede the growing baby’s rights to survive. The answer, so far, according to the courts is yes, up to around the end of the first trimester or so. Until then, mom’s rights supersede the rights of an undeveloped baby. After that, the baby’s rights supersede the woman’s. There is no need to get into a silly debate over when a fetus becomes a person. The debate recognizes that there is a clash of interests between a baby who is presumed to want to survive and a mother who wants to end the pregnancy. A balance was struck at a point relatively early in the pregnancy. This will soon be challenged in the Supreme Court as soon as Ginsburg is gone and a conservative majority forms.
