This is a contract dispute, a type of law that I don't practice. I do know that contract law contemplates damages for things that "can't" be repaired, but I do not know how it would value something like ashes. It's quite possible you can get some money damages, but they would only amount to whatever value was lost by using the wrong sort of tree. Hard to say what that might be.

This is a small claim, and something you can probably handle yourself at the local courthouse by talking to the small claims department. If you want more specific advice, talk to a contracts/business lawyer and see what they recommend. Most likely though, you'll spend more on the lawyer than the damages are worth.
