In your first example, it would be the same here. But in your second example, no. That company can tell him they refuse to provide him service and offer him a refund. He can choose the refund or get nothing in return.

One of the companies I owned and ran was a service-based software company. There were a few times where I had to deny or shut off service. In one instance because so many of the customer's business activities were ran on our software -- their phone system, customer data, accounting -- it literally caused them to shut down and, ultimately, put them into bankruptcy. It was all over the owner of that company being belligerent to my support team. Warned him several times that his behavior was unprofessional and unacceptable, and that if he continued I would order his services disconnected.

He called my bluff, and down went his services. Had one of my system engineers put all of his data on disks and had them delivered by courier.

He sued, we won. He appealed, we won. The trial judge (first judge) gave the owner of the company quite the tongue lashing when he announced his decision, and the appeals court gave a long, written tongue lashing.
