Now you mentioned you aren't "hunting" but tracking. Well, the Virginia State Department of Fish and Wildlife (General Information, n.d.) who regulates the definition of "hunting" states that tracking IS defined as the act of hunting: Hunting and Trapping: The act of or the attempted act of taking, hunting, trapping, pursuing, chasing, shooting, snaring, or netting birds or animals, and assisting any person who is doing the same, regardless of whether birds or animals are actually taken.
It further states, contrary to what you believe, that any land you do not have permission to go on is prohibited: Prohibited Lands: Prohibited lands are any parcels of property, public or private, where established rules and regulations for public access or explicit permission (verbal or written) have not been granted to hunt upon or enter the property (General Information, n.d.)

It even emphasis that: it is unlawful to hunt on private property without the permission of the landowner, and hunters must have the permission of the landowner to track or retrieve wounded game on private property. (General Information, n.d.).
