Grand Rapids wants Open Carry lawsuit tossed out. This is one of the most viewed open carry videos. The comments in the story by the city attorney are outrageous.

I'm discussing the false claim that an action is illegal in most states when that's demonstrably false.

Go look up any Conceal Carry law in any state. Here is Va for you The first few lines of them all are basically:

If any person carries about his person, hidden from common observation, (i) any pistol, revolver, or other weapon designed or intended to propel a missile of any kind... [snip]... any weapon of like kind as those enumerated in this subsection, he is guilty of a Class 1 misdemeanor.

So... it's not illegal to conceal? Line number 1 of the law SAYS IT IS ILLEGAL.

It does not say it's illegal to conceal without a license, just flat out illegal to conceal. That is an important legal distinction. The Driving laws (since you brought it up) say specifically that it is illegal to drive without a license in the first few lines, but the Conceal Carry law says it's flat out illegal right off the bat.

Then the second part of the law says:

It shall be an affirmative defense to a violation of clause (i) regarding a handgun, that a person had been issued, at the time of the offense, a valid concealed handgun permit.

Affirmative defense... to a violation... meaning you can defend yourself from arrest for charges of concealing if you have such a license/permit on your person at the time you are breaking the aforementioned law. It is still illegal to conceal, but a defense you can use to prevent getting arrested is to have this permit on you at the time you are breaking that law.

Make no mistake, IT IS ILLEGAL to conceal carry a firearm. Affirmative Defense means that

An affirmative defense to a civil lawsuit or criminal charge is a fact or set of facts other than those alleged by the plaintiff or prosecutor which, if proven by the defendant, defeats or mitigates the legal consequences of the defendant's otherwise unlawful conduct.

Meaning in order to have such a defense, the actions you took must be unlawful/illegal then you are allowed to use that as an Affirmative Defense.

I've had extensive conversations with lawyers that specialize in firearms law in my state on this matter. You are demonstrably wrong... because I just demonstrated it.
