Lets look at it a different way. YOU are the business owner. You sell Widgets for $19.99, this is purely a digital product, and it tells you which angle to cast your fishing rod in. Jim-Bob really liked the idea you presented, and found a copy of your coding. He is now making a competing product for $14.99, however instead of telling you what angle it is going it, he is able to change the information presented. You, being an honest businessman, go to your tort law attorney, and ask them to file a Cease and Desist to Jim-Bob, so that he is no longer able to disrupt the normal function of your widget, because people are refusing to buy your product until this problem is fixed. Jim-Bob sticks his finger out of his house window when confronted. You're now forced to sue for lost profits.
