People committed to harming other people will do so however they choose, I personally always have a background check run on me, or run on anyone who I'm selling to, but the way that NICS is designed is to dump the record of the background check almost immediately so that a registry is not created. Allowing for this kind of stupid legislation is the quickest way for the guns to be confiscated. And if that's what you're for, then just say as much, and leave.
