Help! My car was totaled in an accident that wasn't my fault and the other person won't admit to it. Their Insurance sided with them and I only have liability.... the damage is evidence enough! Do I go to small claims court?

Insurance companies often play hardball and don’t want to compensate. It’s not unusual for an insurance company to deny liability. If you sue the driver in small claims solely for property damage, then you may not be entitled to additional damages. However, If you have vehicle damage and bodily injuries, seek out a personal injury attorney. They will file a complaint on your behalf or send a demand letter to the insurance company seeking payment. Based off the damage to your car, a PI attorney will gladly assist you through the process. They will take your case on contingency, which means the attorney makes a percentage off your financial recovery.
