The obligations of any agreement (including a rental agreement) are not just what was agreed upon, but also what is considered to be reasonable as is stated in article 248 in Book 6 of the Dutch Civil Code (Burgerlijk Wetboek, art. 6:248 BW).

When the rent is about to end, a reasonable order of operation is that a landlord and tenant plan two inspections together and sign off in writing for both inspections including the energy meter settings when the last inspection is on the day the keys are turned in. That way the tenant can repair any damage that a tenant is required to repair.

The landlord also has to substantiate the damage arose while you were renting by supplying a detailed list of the state of the house when the rent commenced. The house is presumed to be in the state is was in when the rent ends if that list isn't available and regular wear and tear isn't considered damage as stated in art. 7:224 point 2 BW.

QUESTIONS:

A) Did the landlord plan two inspections together with you?
B) Did you sign off on a detailed list of the rental house when the rent commenced or did you acknowledge that otherwise?
C) If that list under (B) exists: did it contain the damage you are now supposed to pay for?
