The Supreme Court declined to hear an appeal to the Ninth Circuit Court of Appeals’ decision in Martin v. City of Boise.

The Ninth Circuit ruling only applies to Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington.

Dozens of cities, including Los Angeles, filed petitions to appeal the ruling

“The creation of a de facto constitutional right to live on sidewalks and in parks will cripple the ability of more than 1,600 municipalities in the Ninth Circuit to maintain the health and safety of their communities,” Boise argued. “Public encampments, now protected by the Constitution under the Ninth Circuit’s decision, have spawned crime and violence, incubated disease, and created environmental hazards that threaten the lives and well-being both of those living on the streets and the public at large.”

So I mean I guess you could say ‘the Supreme Court decided’ but it seems the Ninth Circuit in Boise overturned a previous ruling and the Supreme Court allowed to to stand.

I don’t believe Austin falls under its ruling. Although precedence and the 8th Amendment are likely compelling to City Council.
