Like I said though corporations and high profile claims are in a different realm, not only does the wronged party have the money to sue, they also have the public recognition of their material. A lot of people will run from the media attention too, "Why did you rip of Marvel? Honestly are you daft? Our readers want to know the depths of your stupidity!", the large settlements comes from self-preservation, they pay up and the matter is over with, they don't and their name gets ripped through the coals as the dirty thief they are.

What most writers face is a one on one battle against someone they claim stole their material, the burden of proof remains on them to make their case entirely, they can't just play a few samples and say "See I told ya so!" and have it easily apparent to others, like Kookaburra. Hell a judge can even rule "I don't believe there was any ill intent and that your idea's and writing prose are just very similar, many of the phrases are common terms of speech, case dismissed."

You're onto something with the DMCA complaint though, if you can get their account banned then that'll potentially take away their entire income stream from plagiarism.
