In California, you cannot charge a deposit of more than $1,000.

Your contract can include additional payments but they must relate to materials or work already delivered ...

IT IS AGAINST THE LAW FOR A CONTRACTOR TO COLLECT PAYMENT FOR WORK NOT YET COMPLETED, OR FOR MATERIALS NOT YET DELIVERED. HOWEVER, A CONTRACTOR MAY REQUIRE A DOWNPAYMENT.”
The laws were put in place to protect homeowners from contractors that were under-capitalized.
