But parody is rarely considered plagiarism and that is for one simple reason: The parodist expects and requires that the audience both be familiar with the original work and catch the reference.

Plagiarism is using ones ideas or material as your own.

To me, it is obvious that 1) the material was copied, and 2) without a source there's no way to be sure your audience is familiar with the original work and catch the reference.

Nonetheless, every attempt at a parody is not created equally, and in each instance the particular parody would need to undergo the four factor fair use analysis to determine whether it constitutes a fair use. For example, an attempted parody of a song that borrows too much of the original composition and lyrics, and as a result sounds too much like the original, is less likely to qualify as a fair use.

The less you take, the more likely that your copying will be excused as a fair use. However, even if you take a small portion of a work, your copying will not be a fair use if the portion taken is the “heart” of the work.
