I feel that you don't understand how criminal law works, so here it is: even in cases where there is no chance the defendant will be acquitted, lawyers in Brasil will still ask primarily for innocence because a) if the defendant is affirming his innocence it's normally expected that you do so b) if there's any piece of legislation that might justify the acquittal ITS EVEN MORE your obligation to raise it, and failing to do so might mean a disciplinary action in the attorneys order and c) asking for complete acquittal when you feel there's no chance of it might make the secondary requests like isonomy of the sentence of the starting regime of execution more palatable to the judge.
