First: What do you think "knowingly and willfully" and "to the detriment of the United States" means? Do you think that means that the person has to have an intent to harm the United States, which is why Comey said he wouldn't recommend prosecution?

Second: Deals with "knowingly removes documents without authority". Secretary of State had the authority to remove documents, so this does not apply.

Third: Here is a definition of Gross negligence: it is a conscious and voluntary disregard of the need to use reasonable care, which is likely to cause foreseeable grave injury or harm to persons, property, or both. It is conduct that is extreme when compared with ordinary Negligence, which is a mere failure to exercise reasonable care. Do you think having a private secure email server where only people authorized to handle confidential material had access rises to gross negligence? Or was it merely negligence? Again you would have to show intent.

If you were a lawyer, you would know that words like knowingly and willfully are words used to define types of intent needed to prove a crime. This is some funny shit right here. I can't stop laughing.
