Section 793(f) of the federal penal code criminalizes gross negligence when removing and transmitting highly classified information. Legally speaking negligence normally doesn't require intent i.e if you accidentally kill somebody in some states that is referred to as negligent homicide. In addition, many people have been prosecuted under this statute and intent has never been part of the equation. That means there's legal precedent that supports the idea that intent doesn't matter in this case. I know the FBI brought up intent when they didn't recommend prosecution, but that's like saying I don't recommend prosecuting this bank robber because there's no dead body. Like I'm happy no one got killed, but you don't need a dead body to prove a bank robbery occurred.

If you are referring to Trump's brags about intelligence assets in the middle east, while it definitely cost people's lives it would be effectively impossible to prosecute because the president can classify and declassify information as he sees fit. Intent isn't a factor in either of these cases.

I really don't understand why we can't divorce ourselves from Hillary. I'm sorry but she was a terrible candidate and I don't think she stands for liberal ideals and I don't think moderate america sees her as representing them. I want the house back in the midterms so can we stop defending the indefensible.
