There is no problem moving money when the person who earns the money is not the one at-risk. Virginia is not a community property state, so each spouse can hold property or title in their own, individual name without any involvement or rights in the spouse. Simply take her name off the joint checking account and buy anything that they need in his name only and they are golden.

If she wants to have some spending money just give her a credit card which he pays off from "his" account each month since there are no tax implications on a "gift" between spouses. The only problem they would have is if she has some substantial property titled in her name right now, as that can, as you say, run into fraudulent transactions issues.
