L.A. Democrat Ate Outside At Restaurant Immediately After Voting To Ban Outdoor Dining

No law is that perfect that it can escape having multiple interpretations especially over the course of hundreds of years as the meaning of words change which is why we have courts to make that determination. They are human and not perfect of course, but nor his congress who you believe should be left to determine what is or isn't constitutional. Freedom of religion, freedom of speech, freedom of the press, freedom of assembly, and right to petition all have different meanings to different people and it has changed over time. For a while freedom of religion still allowed a state like Massachusetts to have a state religion. The firearms act of 1938 was unconstitutional, as I'm sure you would agree, and even though scotus didn't rule it as such it wouldn't have even been debated outside of congress without the judicial having the power to rule on it. If we took the constitution literally like an Orginalist we would have no oversight against congressional tyranny. Congress could pass any law they wanted to that wasn't specifically forbidden in the constitution like implementing a one-child policy.

As far as implication I can only assume you have your own unique definition of that word and not how it's regularly used in constitutional law. Like how people misuse the word theory when talking about science.

Here is the clause in the constitution that implicates authority of the courts to conduct judicial review. It's barely implied actually unless you don't think the constitution is a body of laws.

The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;

Again, I think you just want to interpret the constitution your own way while ignoring anyone else's opinion even the founders or the framers. I'm sure you've likely taken the stance because of court decisions you disagree with and a naive assumption that if only your political party had absolute power we wouldn't need any congressional oversight.
