If Mr. Deuters makes a claim about the authenticity of the text messages but did not participate in discovery it would look a little hypocritical of Judge Penny to allow Mr. Deuters to do what Judge Penny harshly criticized Judge Nicol for allowing.

According to the unsealed documents, he admits that the texts are real and that he stands by his UK testimony about them.

So either the texts were kept out on hearsay grounds or they were kept out because they couldn't find it in Deuters' phone (obviously)?

And Neumeister's whole issue is that he couldn't verify the authenticity of Amber's texts because he needed the originals and her to submit her devices directly to Depp's team?
