TV shows make all criminal acts seem like you are going to prison. Remember, the burden of proof is on the prosecution. Cases rarely go to trial because most things are settled with a plea bargain of some sort because the defendant confessed because they liked the offer of less time or less punishment in exchange for confessing, or their attorney advised them to take a plea bargain because they will most likely be found guilty at trial.

If the attorney really feels like they can win a trial, they might push for there to be a trial, and in that case, then the prosecutor has to really think if they want to go to trial now, because the prosecutor doesn't want to lose because it will reflect poorly on them. The case might get thrown out all together because of inconsistencies during the evidence gathering. Any number of things can happen during this entire process.

I'm a justice administration major and I'll have my BS in less than 8 months. Honestly, if I were pulled over and had been drinking, I would probably refuse all tests and take my chances rather than have a DUI on my record. I could live without having a vehicle for however many days. It's not the end of the world, however, having a DUI on my record would severely limit my career opportunities.

That's why it's just best to take an Uber, call City Scoot, or go somewhere within walking distance of your house if that's an option. Don't drink and drive!! Some person texting and driving is going to hit you and it will be completely his or her fault even though you had alcohol in your system. Since you had alcohol in your system, his or her attorney is going to make you out to be the criminal, and the person texting will now own you in civil court, after you've been convicted in criminal court.
