Society isn’t a courtroom. Society sees drug offenses being prosecuted as negative but those are processed all the same.

Societal view vs prosecutorial discretion are not connected.

Should the state decide to prosecute this case there will be a significant burden to demonstrate the facts meeting the statutory test to convict. Even then, when you have a jury there is no telling how they will decide.

The state is inclined to not prosecute in consideration of the evidentiary burden, the resources allocated to a 2-4wk trial, the appellate should they get a conviction and of course the resources designated during the entire time of the parole or [likely not] jail time. The fact that she’s a female is entirely irrelevant to the reality of the majority of jx’s budget to justify prosecuting this. many jxs are even moving away from low level drug because of the burden .

Aside from that reality, male sexual assault does get reported less; but, saying they would get laughed at only perpetuates the idea that their experience isn’t valid. The news will feel strongly about it, sure. But the news isn’t the DA deciding not to prosecute because his ada’s are already overworked as it is.
