I'm not going to be critical of it. Perhaps putting in an escalating escalator in the next CBA would be worthwhile. Right now, the repeater penalty does not continue to increase with each tax year (it's just an extra dollar-for-dollar tax) Maybe each year you pay the repeater penalty in a row, you get an extra repeater penalty. 2nd time repeater? It's an extra 2 bucks. 3rd time repeater? It's an extra 3 bucks. Eventually, teams will cut payroll for a while, helping competitive balance.

The rate for each 5 million dollars goes up by 50 cents...it never changes. Going from 20 to 25 over costs you the same increase as going from 120 to 125 over. Maybe they make it increasingly painful once you hit a certain threshold...20 million to 24,999,999 over is 3.75-to-1 now. 30 million to 34,999,999 is 4.75-to-1.

Perhaps make it escalate. Once you hit 30 million over (only the Nets and Warriors did this last year. Only the Nets, Warriors, and Clippers are there right now for 2022), it starts increasing by more...make it double. Make it double each 5 million past that. There's a level at which it will deter spending in favor of competitive balance.
