That fact that her earning potential is half or a third of his is where divorce court would become a problem for him i.e. she could easily ask and get alimony based on the discrepancies in income/earning potential (depends on the length of the relationship). And this isn't something that a prenup can really protect against.

As for there being a definite trend towards women being favored in court it usually boils down to a combination of the following:

*It's far more socially acceptable and/or economically realistic (i.e. daycare costs) for a woman to permanently or temporarily give up her career because she wants to (i.e. I just don't want to work) or to raise kids (happens more often). *The woman in the relationship having a lower paying job and/or lower earning potential . *Temporary restraining orders being handed out with very little (if any) scrutiny on the claims being made resulting in a relatively difficult legal and financial situation for the party on the receiving end.
