I think you might have a pretty strong misunderstanding of how crimes are charged, before they head to trail. As a result, what you're saying.. makes no sense at all.

To *charge* someone with a crime, all elements of the crime must be met. Taking the life of someone else *may* be *an* element of a crime. But it isn't necessarily. And, as was laid out in explaining each of the charges, it's not the *only* element.

There has to be a suggestions that all the elements were fulfilled *before* it can be considered by a court.

You seem to think that finding elements of a crime is akin to finding innocence or guilt. It's not.
