I’ve been thinking about it since she first posted and I feel like damages are a possibility. Obviously, it depends on her jurisdiction, but a lot of jurisdictions have an unwanted conception or pregnancy tort. They’d probably have a pretty good case for getting prenatal care and labor/delivery costs covered, and maybe even some emotion distress damages. That assessment is limited by the fact that many areas and judges are unwilling to give damages for the cost of raising a child, because it’s just policy to treat human life as not being a detriment or a damage if parents keep a baby, even if the pregnancy itself was unasked for.

I don’t think support would be likely, just because it’s a newer area of law where this is basically a sexual assault resulting in a pregnancy, and the child’s married biological parents would theoretically be caring for it. I also don’t think trying for it would be a good idea because it would create a link between MIL and child, and it would be best to avoid that altogether.
