The "new laws" are just restating what has been illegal forever, more explicitly, more in-your-face, more "here's a new penalty - now pay attention this time!"
I worked at a med-device company that hired sales reps straight out of college, paid them fat commissions if they succeeded, tossed them out within a year if they didn't. Plenty of these kids "colored outside the lines," shared their commissions with docs to get a look at their patient lists so they could go to the patients directly. Of course they got busted. Company held a "training" telling all the reps not to do that (subtext: don't get caught doing that again) or they would be fired. 80% of them were fired within a year anyway and replaced with a fresh batch - think the fresh batch took the training seriously? Maybe they tried a bit harder to not get caught, but the penalty is the same for failing to be in the top 20% of producers as it is for getting caught coloring outside the lines - and what's the most sure-fire way to get into the top 20%? Color outside the lines.
