where is it against the law for an HR representative to ask for the victims opinion on the perpetrators fate? Corporate environment does not equal a court room.

They likely asked this to gauge the response of how serious she was about the situation and what level of outcome would be appropriate. She lowered the risk of the organization by not saying she wanted him terminated.

An HR representative/corporate person (anyone in the professional world/life) can legally lie to you and if it results in an admission it's legally accepted as an admission of guilt. I am sure most people here didn't know that, it doesn't just apply to police officers.
