My wife told me our kid probably isn’t mine biologically.

The law in many states provides there is a “rebuttable presumption” of paternity and any child born during a marriage is presumed to be the natural child of the husband. Rebuttable presumption means that the husband can submit other evidence (e.g. paternity test) showing the child is not his but this determination must be made by a court within a certain amount of time after husband is on notice that he may not be the father.

If you are OK with having the rights and duties of paternity (e.g. visitation and child support payments) then you could not pursue proving another man is the father. If another man is legally declared the father, he may be able to assume those rights/obligations. For you, this may be most relevant if you and mother were to divorce.

Regardless of the legalities, it sometimes is useful to ascertain paternity for medical reasons (e.g. genetic disease).

You have some important choices and may want to consult an attorney in your state.

Good luck. I’m sorry this happened to you.
