What people do not understand is that any NIPR/SIPR communication is classified, it is simply to what degree. Each level has particular restrictions, such as NOFORN which means Classified only to foreign nationals, or Top Secret which requires an need to know, extensive investigation and personal conduct rules to maintain. People buy into the fantasy that something is "Classified" or not as if it is a binary thing. It isn't. Many of the emails she had were increased in security level after their creation, but it was not legal for her to have ANY of these in her private possession even as SecState, afterwards that is getting into espionage territory.

Ok, you're so wrong on classifications here, you may be disregarded. Allow me to help. First, need to know is not TS only, it holds for Secret and even unclassified FOUO to an extent. Second, NOFORN does not mean classified to foreign nationals, it is a modifier for the Secret classification that means it is unreleasable to foreign nationals. It is still not releaseable to US citizens without a Secret clearance and a need to know. Third, TS is not the only clearance with investigation and conduct expectations. Secret requires an extensive background, TS requires a more extensive and SCI required an invasive investogation. Conduct requirements scale with clearance too, as well as even higher requirements for read in to some named programs.

As for the binary argument, it is slightly true. Something is classified or it is not, as the classifying authority dictates via a Security Classification Guide, which can be program specific, and often is. Level of classification then comes into play the same way, it's a binary thing until you reach a "no" to the question "Does it meet this criteria?"
